Marriage is the **other** non-economic route to a second nationality, and it behaves very differently from descent. A descent claim is a statement about the past that is either true or not. A marriage claim is a **relationship the state will examine**, usually over years, and it can be refused on grounds that have nothing to do with documents.

*General information about published nationality statutes, current as of October 2026. Not legal advice. Residence periods and language thresholds change often and the figures below come substantially from secondary guides; verify each one against the ministry that will decide the file.*

## Three different things people call "citizenship by marriage"

1. **Automatic acquisition on marriage.** Historically common, now rare — and where it survives it is usually a vestige of rules that gave a wife her husband's nationality. Most states abolished it precisely because it was both sexist and an obvious fraud vector.
1. **Accelerated naturalisation.** The modern norm. The spouse naturalises on the ordinary terms but with a **shortened residence period**, and usually still faces the language test, the civics test and the good-character check.
1. **Derivative immigration status.** Not citizenship at all: a residence permit or a right of entry derived from the spouse, which may **lead** to naturalisation years later. Most "citizenship by marriage" marketing is really this.

## The accelerated-naturalisation table

Figures are the headline requirements. Nearly all of them carry additional conditions — registration of the marriage, cohabitation, continuity of residence, clean record.

- **Spain — 1 year.** One year of legal residence in Spain while married to a Spanish citizen. Still requires the **A2** Spanish examination and the **CCSE** civics test, and the marriage must be registered in the Spanish Civil Registry. The shortest route in Western Europe.
- **Italy — 2 years resident, 3 years abroad.** Halved where there are children of the marriage. **B1 Italian** has been required since late 2018, and it is a genuine test, not a formality.
- **Portugal — 3 years of marriage**, with no minimum residence in Portugal for the spousal route; ties to the Portuguese community must be shown, and an **A2** certificate is in practice the usual way to show them. Note that the ordinary (non-spousal) residence route was **doubled from 5 to 10 years** by Lei Orgânica 1/2026, which makes the spousal route proportionally much more valuable than it was.
- **Ireland — 3 years** of marriage or civil partnership, with the couple living together and **three of the preceding five years** resident on the island of Ireland. No language test.
- **Israel** — not naturalisation at all. The **Law of Return §4A** extends the rights of a Jew to a **spouse**, and to the **spouse of a child or grandchild** of a Jew. A non-Jewish spouse of the grandchild of a Jew has a route; the only express exclusion is a person who was a Jew and voluntarily changed religion. The qualifying relative need not be alive and need not have immigrated.

The pattern worth extracting: **the better the descent law, the less the marriage law matters** — and vice versa. Ireland's marriage route is slow because its descent route is the most generous in Europe. Spain's is fast because its ancestral windows have closed.

## What the state actually examines

Unlike a descent file, a spousal file is an **adjudication of a relationship**. Expect:

- **Genuineness.** Interviews, sometimes separately; evidence of cohabitation, joint finances, correspondence, photographs over time. Marriage-of-convenience enforcement is vigorous across the EU and in the US, and the penalties are criminal.
- **Subsistence of the marriage at every relevant date.** Separation or divorce part-way through usually ends the claim, and in several systems a divorce **after** grant but within a short window can trigger review.
- **The spouse's own status.** An accelerated route generally requires the citizen spouse to have been a citizen throughout the qualifying period.
- **Language and civics** at the ordinary standard, in nearly every case. Marriage shortens the clock; it rarely removes the examination.

## The recognition problem

A marriage valid where celebrated is **usually** recognised elsewhere, but not always, and the exceptions matter:

- **Same-sex marriage** is not recognised in a substantial number of states, which means a spousal route may simply not exist there regardless of where the marriage was performed. Within the EU, free-movement law requires recognition of a spouse for **residence** purposes even where the member state does not permit such marriages domestically (*Coman*, CJEU 2018) — which is a residence right, not a nationality right.
- **Religious marriages not civilly registered** are a common and avoidable failure: the ceremony happened, the registration did not, and the clock never started.
- **Polygamous marriages** are generally not recognised for these purposes.
- **Common-law and de facto partnerships** are recognised for immigration in some systems (Canada, Australia, New Zealand) and for nationality in very few.

## Marriage and the descent chain

Three ways marriage interacts with an **ancestral** claim, all of which catch people out:

- **Marriage records are the bridge between generations.** A marriage certificate names **both** parties' parents. Where a birth record is lost, the marriage record is frequently the only document proving the link to the generation above — which is why a complete file contains the marriages, not only the births.
- **Name changes break paper trails.** A woman's surname changing on marriage, repeated across four generations and two languages, is the ordinary reason a chain looks broken when it is not. The fix is the certificate, not a theory.
- **Historic marriage rules stripped nationality.** Until the mid-twentieth century many states removed a woman's nationality on marriage to a foreigner, and transmitted only through the father. Those rules are the source of most of the gender-discrimination fixes now written into modern statutes — the UK's pre-1949 provisions, Germany's §15 StAG, Canada's Bills C-31, C-3 and S-3. If a claim runs through a **female** ancestor and appears to fail, check for the remedial provision before concluding there is nothing there. There very often is.

## Tribal nations and indigenous belonging

**Marriage does not confer tribal citizenship** in the ordinary case in any federally recognised nation in the United States. There is no spousal naturalisation. Marriage affects residency on tribal land, some benefits, and — decisively — the eligibility of the **children**.

Under a **blood-quantum** constitution this is the whole mechanism of attrition: each marriage outside the nation halves the quantum of the next generation, and a fixed minimum therefore sets a date after which the nation has no citizens. Under **lineal descent** it has no effect at all, because there is no fraction to dilute. Canada's **second-generation cut-off** does the same work by counting generations rather than fractions, and **Bill S-2** — amended in the Senate to a one-parent rule and before the House committee as of 2026 — is the live attempt to end it. ## Honest summary

Marriage is a real route and it is not a shortcut. It is slower than a descent claim where a descent claim exists, it is examined rather than documented, and it is entangled with a relationship that has to be real and to last. Where it is genuinely the best option — a one-year Spanish file, a Law of Return spousal claim, a Portuguese route that is now three years against an ordinary ten — it is worth knowing precisely, which is what this page is for.

And before pursuing it: **check the ancestral line first.** A grandparent nobody thought about is frequently faster, cheaper and entirely within the applicant's own control.
